Personal Data Protection and Processing Policy

Quy Định Chung/ General Regulations 

Công Ty Cổ Phần Công Nghệ TEKO Việt Nam (sau đây gọi là “Công Ty” hoặc “TEKO”) luôn tôn trọng quyền riêng tư và bảo vệ dữ liệu cá nhân của Quý Khách tuân thủ quy định của pháp luật Việt Nam. Chính sách bảo vệ và xử lý dữ liệu cá nhân này (sau đây gọi là “Chính Sách Bảo Mật”) mô tả cách thức TEKO xử lý và đảm bảo an toàn dữ liệu cá nhân của Quý Khách. 

TEKO Vietnam Technology Joint Stock Company (hereinafter referred to as “the Company” or “TEKO”) always respects your privacy and protects your personal data in compliance with the laws of Vietnam. This Personal Data Protection and Processing Policy (hereinafter referred to as the “Privacy Policy”) describes how TEKO processes and secures your personal data.

Tại từng thời điểm, TEKO có toàn quyền sửa đổi, bổ sung và cập nhật Chính Sách Bảo Mật. TEKO sẽ đăng tải Chính Sách Bảo Mật được sửa đổi, bổ sung trên các website teko.vn, tempi.vn và các nền tảng khác do TEKO sở hữu, vận hành, những thay đổi này có hiệu lực sau khi TEKO đăng trên các website này. Vui lòng xem lại Chính Sách Bảo Mật này thường xuyên để cập nhật bản mới nhất nhằm đảm bảo Quý Khách biết và thực hiện quyền đối với thông tin của mình. Bất kỳ thông tin nào chúng tôi thu thập đều phải tuân theo Chính Sách Bảo Mật có hiệu lực tại thời điểm thông tin đó được thu thập. Vui lòng đọc kỹ các điều khoản Chính sách bảo mật hiện hành trước khi tiếp tục. Việc Quý Khách tiếp tục truy cập, sử dụng các nền tảng khác do Công Ty sở hữu, quản lý, vận hành, sử dụng dịch vụ của Công Ty hoặc tham gia vào các chương trình khuyến mại, chương trình, sự kiện khác của Chúng tôi được hiểu là Quý Khách đồng ý với nội dung Chính Sách Bảo Mật của chúng tôi bao gồm cả nội dung được sửa đổi, bổ sung, và cập nhật tại từng thời điểm.

TEKO reserves the right to amend, supplement and update the Privacy Policy from time to time. TEKO will post the amended, supplemented and/ or updated Privacy Policy on the teko.vn websites, tempi.vn websites and other platforms owned and operated by TEKO, these changes shall take effect on the date  TEKO posts the revised Privacy Policy on these websites. Please regularly review this Privacy Policy to get the latest updates to ensure you know and exercise your right to your personal information. Any information we collect is subject to the Privacy Policy in effect at the time such information is collected. Please read the applicable Privacy Policy terms carefully before proceeding. Your continued access to, use of platforms owned, managed, operated by the Company, or use of the Company’s services, or continued participation in our other promotions, programs and other events constitutes your consent of our Privacy Policy including that  amended, supplemented, and updated Privacy Policy.

Tùy thuộc vào vai trò của TEKO trong từng mối quan hệ cụ thể, TEKO có thể (i) Bên Kiểm soát và xử lý dữ liệu cá nhân; hoặc (ii) Bên Xử lý dữ liệu cá nhân, và theo đó, Chúng Tôi sẽ thực hiện các quyền hạn và trách nhiệm tương ứng theo quy định của pháp luật hiện hành.

Depending on TEKO'S role in each specific relationship, TEKO can be (i) a Personal Data Controller-cum-Processor; or (ii) a Personal Data Processor, and accordingly, We shall exercise the respective rights and responsibilities in accordance with applicable law.

Trong trường hợp, TEKO chỉ là bên xử lý dữ liệu cá nhân, TEKO chỉ tiếp nhận và xử lý xử lý dữ liệu cá nhân theo đúng nội dung của hợp đồng/thỏa thuận mà Chúng Tôi đã giao kết với các Đối Tác. Việc thu thập thông tin cá nhân từ Người Dùng Cuối được thực hiện theo chính sách của Đối Tác, vì vậy TEKO khuyến khích tất cả Người Dùng Cuối đọc, hiểu và chấp nhận chính sách bảo vệ dữ liệu cá nhân liên quan của nền tảng mà bạn truy cập hoặc sử dụng, TEKO luôn được miễn trừ mọi trách nhiệm phát sinh từ việc Người Dùng Cuối truy cập, thực hiện giao dịch trên nền tảng của Đối Tác. 

In case, TEKO is a Data Processor, TEKO only receives and processes personal data in accordance with the contents of the contract/agreement that We have entered into with the Partners. The collection of personal information from End Users is performed in accordance with Partner’s Policy, so TEKO encourages all End Users to read, understand and accept the relevant personal data protection policy of the platform you access or use, TEKO is always disclaimed all liability arising from or out of the End User's access and transactions on the Partner's platform.

Các Thuật Ngữ/ Terminology

1. “Quý Khách” bao gồm:

“Customers” include:

• Các bên truy cập, sử dụng các nền tảng do Công Ty sở hữu, quản lý, vận hành như Website teko.vn, tempi.vn, các ứng dụng/ website khác … hội nhóm trên các trang mạng xã hội thuộc sở hữu, quản lý, vận hành bởi Công Ty (gọi chung là “Nền Tảng”);

The parties access to, use the platforms owned, managed and operated by the Company such as teko.vn website, tempi.vn website, other applications/websites, … groups on social networking sites, owned, managed and operated by the Company (hereinafter referred to as “Platforms”);

• Các tổ chức, cá nhân là khách hàng sử dụng các dịch vụ, phần mềm và các sản phẩm khác do TEKO cung cấp (sau đây gọi chung là “Sản Phẩm”), bao gồm cả các cá nhân do khách hàng là tổ chức chỉ định để sử dụng các dịch vụ, phần mềm này;

Organizations and individuals who are customers using services, software and other products provided by TEKO (hereinafter referred to as "Products"), including individuals designated by that organizations to use these services, software;

• Cá nhân tham gia vào các chương trình khuyến mại do Công Ty tổ chức hoặc tham gia thực hiện, các cuộc khảo sát, trò chơi và các chương trình khác do Công Ty tổ chức.

Individuals participating in promotional programs organized or conducted by the Company, surveys, games and other programs organized by the Company.

2. “Đối Tác” là các cá nhân, tổ chức có giao kết hợp đồng/ thỏa thuận với TEKO, theo đó TEKO sẽ thay mặt Đối Tác để thực hiện một hoặc một số hoạt động xử lý dữ liệu cá nhân của Người Dùng Cuối. 

“Partners” are individuals and organizations that have entered into a contract/agreement with TEKO, whereby TEKO will be on behalf of the Partner to process personal data of the End User.

3. “Người Dùng Cuối” là cá nhân được dữ liệu cá nhân mà TEKO xử lý với vai trò là bên xử lý dữ liệu phản ánh.

 “End User” means individual to whom the personal data which is processed by TEKO as a data processor reflects.

4. “Dữ Liệu Cá Nhân” là thông tin dưới dạng ký hiệu, chữ viết, chữ số, hình ảnh, âm thanh hoặc dạng tương tự trên môi trường điện tử gắn liền với một con người cụ thể hoặc giúp xác định một con người cụ thể.

“Personal Data” is information in the form of symbols, letters, numbers, images, sounds or equivalences on an electronic environment that is associated with a particular person or to identify a particular person.

5. “Xử lý Dữ Liệu” là một hoặc nhiều hoạt động tác động tới Dữ Liệu Cá Nhân, như: thu thập, ghi, phân tích, xác nhận, lưu trữ, chỉnh sửa, công khai, kết hợp, truy cập, truy xuất, thu hồi, mã hóa, giải mã, sao chép, chia sẻ, truyền đưa, cung cấp, chuyển giao, xóa, hủy dữ liệu cá nhân hoặc các hành động khác có liên quan.

“Data Processing” means one or more activities affecting Personal Data, such as: collection, recording, analysis, confirmation, storage, correction, disclosure, combination, access, traceability, retrieval, encryption, decryption, copying, sharing, transmission, provision, transfer, deletion, destruction of personal data or other related actions.

6. “Bên Xử Lý Dữ Liệu” là các tổ chức, cá nhân thực hiện việc xử lý dữ liệu thay mặt cho TEKO thông qua hợp đồng hoặc thỏa thuận với TEKO.

“Data Processors” are organizations and individuals that perform data processing on behalf of TEKO through a contract or agreement with TEKO.

1. Loại Dữ Liệu Cá Nhân được xử lý

1. Trường hợp TEKO là bên kiểm soát và xử lý Dữ Liệu Cá Nhân

When TEKO is the Personal Data Controller-cum-Processor 

Để cung cấp trải nghiệm, Sản Phẩm của TEKO và/hoặc tư vấn, giải đáp các yêu cầu của Quý Khách, TEKO và Bên Xử Lý Dữ Liệu của Chúng tôi hoặc Bên thứ ba (nếu có), tùy từng mục đích sẽ thực hiện một số hoạt động Xử Lý Dữ Liệu của Quý Khách và/hoặc có liên quan đến Quý Khách hoặc giao dịch mà Quý Khách thực hiện với chúng tôi. Theo đó, TEKO, Bên Xử Lý Dữ Liệu của Chúng tôi hoặc Bên thứ ba (nếu có) có thể xử lý các loại Dữ Liệu Cá Nhân bao gồm cả những dữ liệu cá nhân nhạy cảm được quy định dưới đây của Quý Khách, bên thứ ba mà Quý Khách cung cấp cho Chúng Tôi:

In order to provide experience, TEKO Products and/or consultant, respond to your requests, TEKO and our Data Processor or a Third Party (if any) will, depending on the purpose, perform some of processing activities of your personal data and/or in connection with you or the transaction you perform with us. Accordingly, TEKO, Our Data Processor or a Third Party (if any) may process the following types of Personal Data including the sensitive personal data specified below of you, the third party you provide to us:

Họ, chữ đệm và tên khai sinh, tên gọi khác (nếu có); Ngày, tháng, năm sinh; Giới tính; Địa chỉ; Hình ảnh cá nhân; Số điện thoại; mã số thuế; dữ liệu cá nhân phản ánh hoạt động, lịch sử hoạt động trên không gian mạng, chi tiết việc truy cập vào các Nền Tảng mà TEKO sử dụng, quản lý, dữ liệu được tạo ra từ hành vi, hoạt động của Quý Khách được thực hiện trên các Nền Tảng này và các Dữ Liệu Cá Nhân cơ bản khác.

Full name, middle name and birth name, other name (if any); Date of birth; Sex; Address; Nationality; Personal image; Phone number; tax identification number, Information about the individual's digital account; personal data reflecting activity, history of online activities, details of access to the Platforms that TEKO uses and manages, data generated from your behavior, activities performed on these Platforms and other basic Personal Data.

Các Dữ liệu cá nhân nhạy cảm như quan điểm tôn giáo; Tình trạng sức khỏe, đời tư ghi trong hồ sơ bệnh án không bao gồm nhóm máu; Thông tin về đặc điểm di truyền được thừa hưởng hoặc có được của cá nhân; thuộc tính vật lý, đặc điểm sinh học riêng; dữ liệu về tội phạm, hành vi phạm tội được thu thập, lưu trữ bởi các cơ quan thực thi pháp luật; Thông tin khách hàng của tổ chức tín dụng, chi nhánh ngân hàng nước ngoài, tổ chức cung ứng dịch vụ trung gian thanh toán, các tổ chức được phép khác, gồm: thông tin định danh Quý Khách theo quy định của pháp luật, thông tin về tài khoản, thông tin về giao dịch, thông tin về tổ chức, cá nhân là bên bảo đảm tại tổ chức tín dụng, chi nhánh ngân hàng, tổ chức cung ứng dịch vụ trung gian thanh toán; Dữ liệu về vị trí của cá nhân được xác định qua dịch vụ định vị; và Dữ liệu cá nhân khác được pháp luật quy định là đặc thù, cần có biện pháp bảo mật cần thiết.

Sensitive Personal Data such as religious opinions; Health status, personal information stated in health record excluding information on blood group; Information about genetic data related to an individual's inherited or acquired genetic characteristics; individual’s own biometric or biological characteristics; data on crimes, criminal acts collected and stored by law enforcement agencies; Customer’s information of credit institutions, foreign bank branches, payment intermediary service providers, and other authorized organizations, including: information identifying you as prescribed by law, information about your account, information about transactions, information about organizations and individuals who are guarantors at credit institutions, bank branches, and payment intermediary service providers; Personal location data identified through location services; and other Personal Data that is required by law to have the necessary security measures.

2. Trường Hợp TEKO là Bên xử lý dữ liệu cá nhân

When TEKO is the Personal Data Processor 

TEKO xử lý các loại Dữ Liệu Cá Nhân của Người Dùng Cuối thay mặt cho Đối Tác theo các nội dung thống nhất với Đối Tác được quy định tại hợp đồng/ thỏa thuận được ký với TEKO và Đối Tác. TEKO không có mối quan hệ trực tiếp với Người Dùng Cuối có Dữ Liệu Cá Nhân mà chúng tôi xử lý. 

TEKO processes End User’s Personal Data on behalf of the Partners according to the contents agreed with the Partners as specified in the contract/ agreements signed by TEKO and Partners. TEKO has no direct relationship with the End User whose Personal Data we process.

2. Dữ Liệu Cá Nhân được TEKO thu thập với vai trò là bên kiểm soát và xử lý dữ liệu cá nhân

Personal Data collected by TEKO as a personal data controller-cum-processor

TEKO, và Bên Xử Lý Dữ Liệu của chúng tôi có thể thu thập những Dữ Liệu Cá Nhân cần thiết từ Quý Khách trong quá trình chúng tôi cung cấp Sản Phẩm, tăng trải nghiệm của Quý Khách, khi Quý Khách sử dụng các Sản Phẩm của TEKO, yêu cầu tư vấn liên quan, từ các nguồn như:

TEKO, and our Data Processor may collect necessary Personal Data from you during the course of providing Products, improving your experiences, when you use TEKO Products, request related consults, from sources such as:

1. Thông tin mà Quý Khách cung cấp để thực hiện giao dịch, sử dụng Sản Phẩm tại TEKO, khi tham gia vào các chương trình khuyến mại và các chương trình/sự kiện khác của Chúng tôi, các chương trình khảo sát của TEKO; đăng ký, đăng nhập, tương tác trên các Nền Tảng, trong quá trình xử ký khiếu nại, góp ý, yêu cầu chăm sóc khách hàng…

Information that you provide us to conduct transactions, use Products of TEKO, participate in our promotions, other our programs/events and surveys; account registration, login, interact with the Platforms, in the process of handling complaints, suggestions, customer care requests...

Việc cung cấp, thu thập thông tin có thể được thực hiện trực tiếp giữa Quý Khách với TEKO/ Bên Xử Lý Dữ Liệu hoặc với bên thứ ba có thỏa thuận xử lý dữ liệu với TEKO liên quan đến các hoạt động có Xử Lý Dữ Liệu Cá Nhân.

The provision and collection of information can be conduct directly between you and TEKO / Data Processor or with a Third Party that has the data process agreement with TEKO.

Quý Khách đồng ý cho phép TEKO lưu trữ các cuộc gọi, tin nhắn và các hình thức liên hệ khác giữa Quý Khách với Chúng tôi dưới các hình thức ghi âm, ghi hình hoặc hình thức tương ứng phù hợp với hình thức liên hệ để cập nhật hệ thống thông tin, giải quyết các yêu cầu của Quý Khách, nâng cao chất lượng Sản Phẩm và các mục đích khác đảm bảo tuân thủ quy định pháp luật.

You hereby consent to allow TEKO to storage the calls, messages and other communication between you and us under form recording, video recording or respective forms with the communication for updating information system, resolve your requests, improve the Products quality and other purposes in compliance with law.

2. Khi Quý Khách tương tác trên các Nền Tảng, Quý Khách có thể cung cấp, cập nhật, chia sẻ các thông tin công khai và đồng ý cấp quyền cho Chúng tôi được truy cập hay công khai các thông tin này cho bên khác theo quy định của pháp luật, theo đó thông tin công khai bao gồm họ và tên người dùng, tên khác, tên tài khoản, ảnh đại diện, nội dung, bình luận mà Quý Khách chia sẻ trên các Nền Tảng.

When you interact on the Platforms, you can provide, update, share public information and agree to grant us the right to access or publish this information to other parties as required by law, whereby public information includes your first and last name, other name, account name, profile picture, content, comments you share on the Platforms.

3. Các thông tin sinh ra từ việc quý khách truy cập, tương tác trên các Nền Tảng mà TEKO sử dụng, quản lý, điều hành, thông tin sinh ra từ giao dịch giữa Quý Khách và TEKO.

Information generated from your access, interaction on the Platforms that TEKO uses, manages, operates, information generated from transactions between you and TEKO.

4. Từ nguồn của bên thứ ba, mà Quý Khách đồng ý cho phép thu thập, xử lý Dữ Liệu Cá Nhân và chia sẻ cho TEKO.

From a third party that you agree to allow collecting, processing Personal Data and sharing with TEKO.

5. Từ nguồn khác (nếu có) mà việc thu thập được cho phép thực hiện theo quy định của pháp luật.

From other sources (if any) that are allowed to be collected according to the provisions of law.

3. Cookies

Các Nền Tảng của TEKO cũng sẽ sử dụng cả thông tin nhận diện cá nhân của Quý Khách và một số thông tin nhận diện phi cá nhân (như cookies, địa chỉ IP, loại trình duyệt, ngày tổng số, v.v.) để gia tăng khả năng đáp ứng và cải thiện của các Nền Tảng này, cũng như về phát triển những chức năng, tính năng và các dịch vụ, sản phẩm mới theo những xu hướng và sở thích đang diễn tiến, đồng thời nâng cấp trải nghiệm của Quý Khách.

The TEKO Platforms will also use both your personally identifiable information and certain non-personally identifiable information (such as cookies, IP address, browser type, total date, etc.) to increase the responsiveness and improvement of these Platforms, and to develop new functions, features, services and products according to evolving trends and preferences, and to improve your experience.

Quý khách có thể quản lý Cookies trình duyệt bằng việc cài đặt trình duyệt của mình, chặn hoặc ngừng hoạt động Cookies, giới hạn việc chia sẻ của chúng tôi về một số Dữ Liệu của Quý Khác thông qua cài đặt thiết của Quý Khách. 

You can manage browser Cookies by setting your browser, blocking or deactivating Cookies, limiting your sharing of some of your Data through your settings.

4. Mục đích và cách thức xử lý Dữ Liệu Cá Nhân

Purpose and manner of processing Personal Data

1. Khi TEKO là Bên Kiểm Soát và xử lý Dữ Liệu Cá Nhân

When TEKO is the Personal Data Controller-cum-Processor

TEKO, Bên Xử Lý Dữ Liệu của Chúng tôi hoặc Bên thứ ba (nếu có) sẽ thực hiện một hoặc một số hoạt động Xử Lý Dữ Liệu của Quý Khách cho các mục đích xử lý dữ liệu cá nhân dưới đây:

TEKO, Our Data Processor or a Third Party (if any) will perform one or more processing activities of your data for the following purposes:

• Cung cấp các Sản Phẩm và tiện ích đến Quý Khách dựa trên nhu cầu và các thói quen của Quý Khách khi truy cập vào các Nền Tảng của TEKO; tạo mới, quản trị và cập nhật tài khoản Quý Khách, xác minh danh tính Quý Khách; và/hoặc

Provide Products and utilities to you based on your needs and habits when accessing the TEKO’s Platforms; create, administer and update your account, verify your identity; and/or

• Quản lý, vận hành, cung cấp và/hoặc quản trị việc sử dụng, hoạt động của Quý Khách khi truy cập, đăng nhập, thực hiện giao dịch, tương tác trên Nền Tảng; và/hoặc

Manage, operate, provide and/or administer your use and activities when accessing, logging in, performing transactions, interacting on the Platform; and/or

• Thực hiện các hoạt động nội bộ cần thiết để cung cấp Sản Phẩm, bao gồm khắc phục các lỗi phần mềm và sự cố vận hành, tiến hành phân tích dữ liệu, thử nghiệm, nghiên cứu, giám sát và phân tích xu hướng sử dụng và hoạt động; và/hoặc

Perform necessary internal activities to deliver the Product, including troubleshooting software errors and operational problems, conducting data analysis, testing, research, monitoring, and analysis of usage and activity trends; and/or

• Gửi các thông báo, cập nhật, tài liệu, thông tin quảng cáo, khuyến mại, lời chúc, lời mời, quản lý sự tham gia và các tài liệu liên quan đến sự kiện hoặc chương trình khuyến mại cho Quý Khách; và/hoặc

Send notices, updates, documents, advertising information, promotions, wishes, invitations, attendance management and other documents related to the event or promotion program to you; and/or

• Phát hiện, ngăn chặn các hoạt động giả mạo, phá hủy tài khoản người dùng của Quý Khách hoặc các hoạt động giả mạo Quý Khách; và/hoặc

Detect, prevent fake activities, destruction of your account or impersonation; and/or

• Liên lạc, trao đổi thông tin và giải quyết các vấn đề với Quý Khách trong những trường hợp đặc biệt; và/hoặc

Communicate, exchange information and solve problems with Customers in special cases; and/or

• Lưu trữ, quản lý, dự phòng cho việc khắc phục sự cố hay cho các mục đích tương tự khác; và/hoặc

Storage, management, backup for troubleshooting or other similar purposes; and/or

• Nghiên cứu thị trường và các báo cáo phân tích: Công Ty có thể dùng Thông Tin Quý Khách để nghiên cứu thị trường, tổng hợp, phân tích thông tin chung của Quý Khách (ví dụ độ tuổi trung bình, khu vực địa lý), thông tin chi tiết sẽ được ẩn và chỉ được dùng để phục vụ công việc thống kê; và/hoặc

Market research and analysis reports: The Company may use your Information to conduct market research, synthesize and analyze your general information (eg average age, geographical area), detailed information will be hidden and used only for statistical work; and/or

• Các mục đích hợp pháp khác phù hợp với mục tiêu và chính sách của Công Ty tại từng thời điểm (nếu có); và/hoặc

Other lawful purposes consistent with the Company's objectives and policies from time to time (if any); and/or

• Để thực hiện các nghĩa vụ của Công Ty theo quy định của pháp luật hiện hành bao gồm nhưng không giới hạn như việc công bố thông tin, báo cáo theo quy định của pháp luật về khuyến mại, lưu trữ hồ sơ, kiểm toán, điều tra và giải quyết khiếu nại, tranh chấp và thực hiện theo yêu cầu của cơ quan Nhà nước có thẩm quyền.  

To perform the Company's obligations in accordance with applicable laws, including but not limited to information disclosure, reporting in accordance with the law on promotion, record keeping, auditing, investigation and settlement of complaints and disputes, and implementation at the request of competent State agencies.

• Chúng Tôi có trách nhiệm hợp tác cung cấp thông tin cá nhân Quý Khách khi có yêu cầu từ cơ quan Nhà nước có thẩm quyền. Ngoài ra, không ai có quyền xâm phạm vào thông tin cá nhân của Quý Khách.

We are responsible for cooperating in providing your personal information upon request from a competent State agency. In addition, no one has the right to infringe on your personal information.

2. Khi TEKO là Bên xử lý Dữ Liệu Cá Nhân

When TEKO is a Personal Data Processor

Đối Tác của TEKO quyết định mục đích, phương tiện Xử Lý Dữ Liệu Cá Nhân của Người Dùng Cuối, TEKO sẽ thực hiện một số hoạt động Xử Lý Dữ Liệu Cá Nhân của Người Dùng Cuối theo nội dung thỏa thuận với Đối Tác.

TEKO's Partner decides the purpose and means of End Users personal Data Processing, TEKO will perform some End User's Personal Data Processing activities according to the content of the agreement with the Partner.

5. Thời gian bắt đầu và kết thúc xử lý dữ liệu

Data processing start and finish time

1. TEKO bắt đầu xử lý Dữ Liệu Cá Nhân của Quý Khách, Người Dùng Cuối kể từ thời điểm nhận được Dữ Liệu Cá Nhân.

TEKO starts processing your Personal Data, End User from the moment of receipt of Personal Data.

2. Thông tin cá nhân của Quý Khách sẽ được xử lý, lưu trữ trong thời gian cần thiết để được hiện các mục đích hoặc đảm bảo việc tuân thủ các quy định pháp luật có liên quan.

Your personal information will be processed and stored for as long as necessary to fulfill the purposes or ensure compliance with relevant laws.

3. Trong mọi trường hợp thông tin cá nhân của Quý Khách sẽ được bảo mật trên máy chủ của Công Ty và/hoặc đối tác cung cấp dịch vụ lưu trữ dữ liệu cho Công Ty.

4. Thông Tin Cá Nhân của Người Dùng Cuối mà chúng tôi xử lý sẽ được lưu trữ trong thời gian cần thiết để cung cấp dịch vụ cho Đối Tác theo thỏa thuận với Đối Tác.

End User’s Personal Information that we process shall be stored for as long as necessary to provide services to the Partner as agreed with Partner.

5. Chúng tôi cũng sẽ giữ lại Thông Tin Cá Nhân này khi cần thiết để đảm bảo tuân thủ quy định pháp luật liên quan hoặc để giải quyết tranh chấp.

We will also retain these Personal Information as necessary to ensure compliance with relevant laws or to resolve disputes.

6. Chia Sẻ Dữ Liệu 

Data Sharing

1. Khi TEKO là Bên kiểm soát và xử lý dữ liệu cá nhân

Công Ty không bán Dữ Liệu Cá Nhân của Quý Khách, Chúng Tôi chỉ chia sẻ Dữ Liệu trong phạm vi cần thiết, như được quy định dưới đây theo Chính Sách Bảo Mật này. Các bên được chia sẻ Dữ Liệu Cá Nhân của Quý Khách phải cam kết tuân thủ nghiêm ngặt các quy định của pháp luật và các quy định liên quan tại Chính Sách Bảo Mật này. Cụ thể:

The Company does not sell your Personal Data, We only share it to the extent necessary, as set forth below in accordance with this Privacy Policy. The parties to whom your Personal Data are shared must undertake to strictly comply with the provisions of the law and the relevant provisions of this Privacy Policy. Specifically:

Việc chia sẻ này giúp Công Ty có thể cung cấp cho Quý Khách các thông tin về các sản phẩm và dịch vụ, và vấn đề khác mà Quý Khách có thể quan tâm. Trong trường hợp này, các công ty thành viên của Tập Đoàn Kinh Tế, các công ty liên kết và đối tác của Công Ty được cấp quyền truy cập Dữ Liệu Cá Nhân của Quý Khách, họ sẽ phải tuân thủ nghiêm ngặt các quy định được mô tả trong Chính Sách Bảo Mật này.

Exchange of Data with subsidiaries, affiliated companies, other companies in the economic group of which the Company is a member ("Economic Group") and partners that have signed an association agreement to take care of you with the Company: The Company may share your Personal Data with the member companies of the Economic Group, affiliated partners and linked websites of the Company. This sharing enables the Company to provide you with information about products and services, and other matters that may be of interest to you. Trao đổi Dữ Liệu Cá Nhân của Quý Khách các bên thứ ba là đối tác của Công Ty: Công Ty có thể chuyển Dữ Liệu Cá Nhân của Quý Khách cho các đối tác là cố vấn, chuyên gia, nhà cung cấp dịch vụ, nhà thầu phụ để làm phân tích dữ liệu, tiếp thị, hỗ trợ dịch vụ, nhà cung cấp dịch vụ máy chủ, dịch vụ công nghệ thông tin, nhà cung cấp lưu trữ đám mây; đối tác quảng cáo và nhà cung cấp nền tảng quảng cáo…. Công Ty cũng có thể trao đổi Dữ Liệu Cá Nhân của Quý Khách với bên thứ ba cho mục đích chống gian lận và giảm rủi ro tín dụng, chống rửa tiền;

Exchange of your Personal Data with third parties that are partners of the Company: The Company may transfer your Personal Data to partners who are consultants, experts, service providers, subcontractors for data analysis, marketing, service support, server service providers, information technology services, cloud storage providers; advertising partners and advertising platform providers…. 5. Trao đổi Dữ Liệu Cá Nhân của Quý Khách với những đơn vị kinh doanh khác mà Công Ty có kế hoạch sáp nhập hoặc mua lại: Trong trường hợp này, Công Ty sẽ yêu cầu những đơn vị đó tuân thủ nghiêm ngặt theo Chính Sách này.

Exchange of your Personal Data with other business units with which the Company plans to merge or acquire: In this case, the Company will require those entities to strictly comply with this Policy.

6. Tiết lộ tài khoản và Dữ Liệu Cá Nhân của Quý Khách khi Công Ty tin rằng việc đó là phù hợp để tuân thủ pháp luật, để thực thi hoặc áp dụng các điều khoản và thỏa thuận khác của Công Ty hoặc để bảo vệ quyền, tài sản hoặc an ninh của Công Ty, Quý Khách, hoặc bất kỳ người nào khác. Các công việc nêu trên có thể bao gồm việc trao đổi thông tin với các công ty và tổ chức khác để ngăn chặn và phát hiện gian lận và giảm rủi ro.

Disclose your account and Personal Data when the Company believes it is appropriate to comply with the law, to enforce or apply other terms and agreements of Company, or to protect the rights, property or security of the Company, you, or any other person. The foregoing may include exchanging information with other companies and organizations to prevent and detect fraud and reduce risk.

7. Thực hiện theo yêu cầu của các cơ quan nhà nước có thẩm quyền, hoặc theo quy định của pháp luật.

Comply with the requirements of competent state agencies, or as prescribed by law.

Ngoài các trường hợp nêu trên, Công Ty sẽ có thông báo cụ thể cho Quý Khách khi phải tiết lộ Dữ Liệu Cá Nhân của Quý Khách cho một bên thứ ba. Trong trường hợp này, Công Ty cam kết sẽ chỉ tiết lộ Dữ Liệu Cá Nhân của Quý Khách khi được sự đồng ý của Quý Khách.

For any addition to the above cases, the Company will give you specific notice when we have to disclose your Personal Data to a third party. In this case, the Company undertakes to disclose your Personal Data only with your consent.

2. Khi TEKO là Bên xử lý dữ liệu cá nhân

When TEKO is a Personal Data Processor

Mọi hoạt động chia sẻ Dữ Liệu Cá Nhân của Người Dùng Cuối với bất kỳ bên thứ ba nào sẽ được thực hiện theo yêu cầu của Đối Tác hoặc theo quy định của pháp luật. TEKO luôn được miễn trừ mọi trách nhiệm phát sinh liên quan khi Chúng Tôi thực hiện việc chia sẻ dữ liệu theo yêu cầu của Đối Tác.

Any sharing of End User's Personal Data with any third party shall be carried out at the request of the Partner or as required by law. TEKO is always disclaimed from all liabilities arising in connection with We performing the data sharing at the request of the Partner.

7. Bảo Vệ Dữ Liệu Cá Nhân

Personal Data Protection

Việc xử lý dữ liệu cá nhân có thể gây ra rủi ro rò   liệu hoặc xử lý không phù hợp. Do đó, TEKO luôn coi trọng áp dụng các biện pháp quản lý và biện pháp kỹ thuật để bảo vệ dữ liệu cá nhân trong suốt quá trình xử lý dữ liệu (Chúng tôi triển khai áp dụng các biện pháp bảo vệ dữ liệu cá nhân kể từ thời điểm bắt đầu thu thập dữ liệu cá nhân).

The processing of personal data may pose a risk of data leakage or inappropriate handling. Therefore, TEKO always attaches great importance to applying management measures and technical measures to protect personal data during data processing (We have applied personal data protection measures since the time we started collecting personal data).

8. Quyền và nghĩa vụ của Quý Khách

Customer’s rights and obligations

1. Quý Khách được quyền truy cập để xem và chỉnh sửa Dữ Liệu Cá Nhân mà TEKO đã thu thập, theo đó:

You are entitled to access to view and modify your Personal Data collected by TEKO, accordingly:

1. Quý Khách có quyền cung cấp thông tin cá nhân cho TEKO và có thể thay đổi quyết định đó vào bất cứ lúc nào. 

You have the right to provide personal information to TEKO and can change that decision at any time.

2. Quý Khách có quyền tự kiểm tra, cập nhật, điều chỉnh thông tin cá nhân của mình bằng cách đăng nhập vào tài khoản và chỉnh sửa thông tin cá nhân hoặc yêu cầu Công Ty thực hiện việc này. Nếu Quý Khách không thể tự truy cập hoặc cập nhật một số thông tin của mình, Quý Khách luôn có thể liên hệ với Công Ty để được hỗ trợ bằng việc gửi thue đến email của bộ phận chăm sóc khahcs hàng là support@teko.vn.

You have the right to check, update and adjust your personal information yourself by logging into your account and correcting personal information or requesting the Company to do this. If you are unable to access to or update your information yourself, you can always contact the Company for assistance at support@teko.vn.

2. Nếu Quý Khách không muốn nhận tin nhắn quảng cáo từ Công Ty, vui lòng hủy đăng ký hoặc điều chỉnh tùy chọn liên lạc của Quý Khách theo hướng dẫn của Công Ty tại từng thời điểm. Nếu Quý Khách không muốn nhận thông báo trên website từ Công Ty, vui lòng điều chỉnh cài đặt thông báo trong ứng dụng hoặc thiết bị của Quý Khách.

If you do not want to receive advertising messages from the Company, please unsubscribe or adjust your communication preferences as instructed by the Company from time to time. If you do not want to receive notifications on website from the Company, please adjust the notification settings in your application or device.

3. Quý Khách có nghĩa vụ đảm bảo thông tin cung cấp cho Chúng tôi là đầy đủ, chính xác và luôn được cập nhập nhằm đảm bảo quyền lợi của Quý Khách. Công Ty không chịu trách nhiệm nếu có vấn đề phát sinh trong trường hợp Quý Khách cung cấp không chính xác hoặc đầy đủ thông tin theo yêu cầu (nếu có).

You are obliged to ensure that the information provided to us is complete, accurate and up-to-date to ensure your interests. The Company is not responsible if problems arise in case you provide incorrect or incomplete information as requested (if any).

4. Quý Khách sẽ tự chịu trách nhiệm về bảo mật và lưu giữ các thông tin như tên đăng ký, mật khẩu và hộp thư điện tử của mình. Ngoài ra, Quý Khách có trách nhiệm thông báo kịp thời cho TEKO về những hành vi sử dụng trái phép, lạm dụng, vi phạm bảo mật, lưu giữ tên đăng ký và mật khẩu của bên thứ ba để có biện pháp giải quyết phù hợp.

You will be solely responsible for the security and retention of information such as your registration name, password and email address. In addition, you are responsible for promptly notifying TEKO of unauthorized use, abuse, breach of security, retention of registered name and password of third parties for appropriate remedial measures.

5. Để làm rõ, Chính sách Bảo Mật này áp dụng với Quý Khách. Bằng việc cung cấp dữ liệu cá nhân của bên thứ ba (thông tin của người nhận hàng, thông tin của người giới thiệu …) cho Công Ty, Quý Khách cam kết và bảo đảm rằng Quý Khách đã có được sự đồng ý của bên thứ ba đó cho việc xử lý các dữ liệu cá nhân của bên thứ ba cho các mục đích và quy định được nêu tại Chính Sách Bảo Mật này.

For clarification, this Privacy Policy applies to you. By providing third party’s personal data (consignee information, referrer information ...) to the Company, you represent and warrant that you have obtained such third party's consent for the third party's processing of personal data for the purposes and provisions set out in this Privacy Policy.

6. Người Dùng Cuối muốn truy cập, sửa đổi hoặc xóa Thông Tin Cá Nhân của mình có thể liên hệ với Đối Tác đã thu thập thông tin cá nhân của Người Dùng Cuối. TEKO sẽ thực hiện yêu cầu xóa hoặc điều chỉnh Thông Tin Cá Nhân của Người Dùng Cuối theo đề nghị của Đối Tác trong phạm vi pháp luật cho phép.

End Users desire to access, modify or delete your Personal Information can contact the Partner who collected the End User's personal information. TEKO shall fulfill the request to modify or delete the Personal Information of the End User at the request of the Partner to the extent permitted by law.

9. Cơ chế tiếp nhận và giải quyết khiếu nại của người tiêu dùng liên quan đến việc thông tin cá nhân bị sử dụng sai mục đích hoặc phạm vi đã thông báo

Mechanism for receiving and resolving consumer’s complaints in case Personal information is used for the wrong purpose or out of scope notified

1. Trong trường hợp Quý Khách có nghi ngờ về việc thông tin cá nhân của Quý Khách bị sử dụng sai mục đích hoặc phạm vi đã thông báo tại Chính Sách Bảo Mật của TEKO, Quý Khách có thể gửi các khiếu nại và/hoặc thắc mắc này đến Công Ty thông qua email của bộ phận chăm sóc là support@teko.vn

In case you have doubts about your personal information being used for the wrong purpose or out of scope notified in TEKO's Privacy Policy, you can send these complaints and/or inquiries to the Company through the email of support@teko.vn.

2. Khi tiếp nhận những khiếu nại này, Công Ty sẽ xác nhận lại thông tin, bằng các biện pháp nghiệp vụ cụ thể để giải quyết các khiếu nại/ thắc mắc của Quý Khách

When receiving these complaints, the Company will confirm the information, by specific professional measures to resolve your complaints/inquiries.

3. Trường hợp, Quý Khách không đồng ý với nội dung giải quyết khiếu nại của Công Ty, Quý Khách có thể gửi khiếu nại đến các cơ quan Nhà nước có thẩm quyền để được giải quyết.

In case you do not agree with the Company's complaint settlement, you can send your complaint to the competent State agencies for settlement.

4. Nếu có bất kỳ thắc mắc, thông tin khiếu nại hoặc cần hỗ trợ liên quan đến thông tin cá nhân, vui lòng liên hệ với tổng đài chăm sóc Quý Khách của chúng tôi.
